Acorn Office Furniture Usage Agreement
Agreement to policies, terms and conditions
By choosing to visit and use the Acorn Office Furniture Website you
agree to all policies, terms and conditions presented on this site. If
any of these conditions shall be deemed invalid, void, or for any reason
unenforceable, that condition shall be deemed severable and shall not
affect the validity and enforceability of any remaining condition.

conditions on this site.
Pricing and payment
Please be advised that as this is a South African website and that you
will ultimately be charged in South African Rand based on the ruling
exchange rate at the time your order is processed. While policy varies
from country to country and bank to bank, your bank may charge you a
foreign currency conversion fee.
Agreements of sale
In the case of eCommerce ability, placing an item in a shopping basket
or adding it to a wish list without completing the entire purchase
process does not:
• Constitute an agreement of sale with Acorn Office Furniture and users
cannot hold Acorn Office Furniture liable if such items are not
available when the purchase process is completed later; and/or
• Constitute an order for such an item; and
• Acorn Office Furniture may remove such an item from the shopping
basket or wishlist if no stock is available.
An agreement of sale between Acorn Office Furniture and a user only
comes into effect if and when:
• A credit card authorisation is received from the issuing bank; or
• A deposit of an electronic transfer is reflected on Acorn Office
Furniture’s bank statement (and only if such payment is received within
5 (five) business days after completion of the purchase cycle); or
• A direct deposit is reflected on Acorn Office Furniture’s bank
statement and ratified by the bank (and only if such payment is received
within 5 (five) business days after completion of the purchase cycle).
Acorn Office Furniture reserves the right to refuse to accept and/or
execute an order without giving any reasons. Acorn Office Furniture also
reserves the right to cancel orders in whole or in part as circumstances
dictate. Acorn Office Furniture shall only be liable to refund monies
already paid by the user.
Acorn Office Furniture shall take all reasonable efforts to maintain
correct prices. However, should errors occur and items are offered at
incorrect prices, Acorn Office Furniture will not be obliged to sell
goods at such incorrect prices and shall only be liable to refund monies
paid.
License and site access
Acorn Office Furniture grants you a limited license to access and make
personal use of this site and not to download (other than page caching
or where downloads are specifically offered) or modify it, or any
portion of it, except with express written consent of Acorn Office
Furniture. This license does not include any resale or commercial use of
this site or its contents, any collection and use of any product
listings, descriptions, or prices, any derivative use of this site or
its contents, any downloading or copying of account information for the
benefit of another merchant, or any use of data mining, robots, or
similar data gathering and extraction tools. This site or any portion of
this site may not be reproduced, duplicated, copied, sold, resold,
visited, or otherwise exploited for any commercial purpose without
express written consent of Acorn Office Furniture. You may not frame or
utilize framing techniques to enclose any trademark, logo, or other
proprietary information (including images, text, page layout, or form)
of Acorn Office Furniture without express written consent. You may not
use any meta tags or any other "hidden text" utilizing Acorn Office
Furniture’s name or trademarks without the express written consent of
Acorn Office Furniture. Any unauthorized use terminates the permission
or license granted by Acorn Office Furniture.
Your membership or account
If you use this site, you are responsible for maintaining the
confidentiality of your membership or account name and number and for
restricting access to your computer, and you agree to accept
responsibility for all activities that occur under your account or
password. Acorn Office Furniture reserve the right to refuse service,
terminate accounts, remove or edit content, or cancel orders in its sole
discretion.
Reviews, comments, communications and other content
Users may post reviews, comments, and other content, and submit
suggestions, ideas, comments, questions, or other information, so long
as the content is not illegal, obscene, threatening, defamatory,
invasive of privacy, infringing of intellectual property rights, or
otherwise injurious to third parties or objectionable and does not
consist of or contain software viruses, political campaigning,
commercial solicitation, chain letters, mass mailings, or any form of
"spam." You may not use a false e-mail address, impersonate any person
or entity, or otherwise mislead as to the origin of a card or other
content. Acorn Office Furniture reserves the right (but not the
obligation) to remove or edit such content.
If you do post content or submit material, and unless we indicate
otherwise, you grant Acorn Office Furniture a non-exclusive,
royalty-free, perpetual, irrevocable, and fully sub-licensable right to
use, reproduce, modify, adapt, publish, translate, create derivative
works from, distribute, and display such content throughout the world in
any media. You grant Acorn Office Furniture the right to use the name
that you submit in connection with such content, if they choose. You
represent and warrant that you own or otherwise control all of the
rights to the content that you post, that the content is accurate, that
use of the content you supply does not violate this policy and will not
cause injury to any person or entity, and that you will indemnify Acorn
Office Furniture or its affiliates for all claims resulting from content
you supply. Acorn Office Furniture has the right but not the obligation
to monitor and edit or remove any activity or content. Acorn Office
Furniture takes no responsibility and assumes no liability for any
content posted by you or any third party.
Electronic communications
When you visit Acorn Office Furniture or send e-mails to Acorn Office
Furniture, you consent to receiving communications from Acorn Office
Furniture electronically and agree that all agreements, notices,
disclosures and other communications sent by Acorn Office Furniture
satisfy any legal requirements, including, but not limited to, the
requirement that such communications should be "in writing".
Governing Law
By accessing this Website, you agree that the laws of the Republic of
South Africa, without regard to the conflict of laws and principles
thereof, will apply to all matters relating to use of this Website. You
also submit to the personal jurisdiction of the Republic of South Africa

Disputes
In the event of any dispute of any nature whatsoever arising between
Acorn Office Furniture and the user on any matter provided for in, or
arising out of this agreement, and not resolved through communication
with Acorn Office Furniture, then such dispute shall be submitted to
confidential arbitration in terms of the expedited rules of the
Arbitration Foundation of South Africa. Arbitration proceedings shall be
conducted in South Africa in English.
Domicilium
Acorn Office Furniture chooses as its domicilium citandi et executandi
for all purposes under this agreement, whether in respect of court
process, notice, or other documents or communication of whatsoever
nature:

Changes to this agreement and terms of use
Acorn Office Furniture may, at its sole discretion, change this
agreement or any part thereof at any time without notice.
